"Arbitrariness from the side of the military unit." Can a person be sent to the front without military experience - a lawyer

In Ukraine, martial law and general mobilization will last until August 23. There is currently no official information about whether they are going to extend them. They will probably be prolonged. Despite the fact that the network regularly spreads about the waves of mobilization, no law provides an appropriate concept ("waves"), the lawyer Kateryna Anishchenko told. The mobilization process is governed by the Presidential Decree No.

69/2022 on general mobilization, the Law of Ukraine on mobilization training and mobilization and the Law of Ukraine on military duty and military service. “The said laws state that the protection of the Fatherland is a constitutional duty of every citizen and it is a matter of the whole people. Making a contribution to preserving the territorial integrity of the state and the peaceful life of the people of Ukraine is a matter of honor and duty of every citizen.

That is, they do not talk about any waves and queues, - the human rights activist explained. - At the same time, the Ministry of Defense has repeatedly emphasized that first of all, the acquisition of combat military units is carried out by reservists, former participants of the ATO and OOS, with a gradual increase in the number of units at the expense of those servicemen and servicemen who have already served. That is, preference is given to persons with combat experience.

However, this does not mean that without experience will not mobilize. " Can a person be sent to the front without his or her consent? During martial law and general mobilization - yes. Anishchenko explained that the law provides a citizen's obligation to preserve the territorial integrity of the state. Therefore, the desire of conscripts is not taken into account in this case. However, persons who are called to the army cannot be sent to the front without proper training.

That is, persons without any military and combat experience can mobilize to the army, but will not be sent to hot spots immediately - it is illegal and illegal. Anishchenko added that she was aware of cases where persons were sent to the forefront without experience. According to her, these cases concerned volunteers who independently expressed a desire to go to "zero" and sign their signature on the corresponding papers.

“If such arbitrariness occurs from the military unit, then I recommend that you contact the commander with a report in which to ask you to send you to study, because you do not have sufficient experience or no ammunition, etc. As experience showed - such reports, when they are given, have their own result, ”the lawyer said. We will remind, since October 1, a large number of women in Ukraine should be on military accounting, after which they will officially become servicemen.
