The "execution" of the Soldiers of the Armed Forces of the Russian Federation in Makiivka: Ukrainian prosecutors declared imitation

The Office of the Prosecutor General of Ukraine got acquainted with the video on the Internet, where a dozen occupiers "surrendered" were captured. Their actions were qualified as treachery to call the enemy's trust. The Russian military imitated captivity and opened fire on Ukrainian servicemen. This was reported on Facebook by the Office of the Prosecutor General of Ukraine (OGP).

The Luhansk Regional Prosecutor's Office has entered information into the Unified Register of Pre -trial Investigations on the fact of committing the Armed Forces of the Armed Forces of the Russian Federation. Criminal proceedings were initiated under the article of violation of the laws and customs of war (Part 1 of Article 438 of the Criminal Code of Ukraine), noted in the office.

"According to the results of media monitoring, it became known that in the village of Makiivka, the Russian military, imitating the delivery of the Armed Forces, opened fire on Ukrainian defenders. Such actions are prohibited by international humanitarian law," the prosecutors said. During the pre -trial investigation, all the circumstances of the event will be established and all its participants were given a legal assessment, law enforcement officers assured.

Pursuant to Article 37 of the additional protocol to the Geneva Conventions of August 12, 1949 on the protection of victims of international armed conflicts, it is forbidden to kill, injure, or capture an enemy by resorting to treachery. Faithing is considered to be actions aimed at calling the enemy's trust in order to force him to believe in the right to defense. The investigation into the incident continues, said OGP.
